Aequam servare mentem

The firm advises individuals, institutions and fellow lawyers in two legal systems that rarely meet in the same practitioner: the canon law of the Catholic Church and the civil law of Italy.

Avvocato Gianluca Benedetti has practised in Rome since 1998. He has been enrolled as an Advocate of the Roman Rota since 1998, as an Advocate before the courts of Vatican City State since 2000, and before the Italian Supreme Court of Cassation since 2011.

One practical consequence of this dual admission is worth stating at the outset. A sentence of nullity handed down by an ecclesiastical tribunal has no effect of itself in Italian civil law: separate proceedings before the Court of Appeal are required before it is recognised. These are two proceedings, governed by two legal systems, requiring two distinct admissions to practise. The firm handles the whole of that course, from the initial petition to the civil judgment of recognition.
